CHEHALIS, Wash. -- Portland Trail Blazers guard Damon Stoudamire agreed Thursday to attend drug and alcohol counseling and stay out of legal trouble for the next year to have marijuana charges against him dropped.
Stoudamire and teammate Rasheed Wallace were passengers in a vehicle that was stopped for speeding Nov. 22 on a highway outside Chehalis following a game against Seattle. A search turned up a small amount of marijuana, police said.
Stoudamire, Wallace and driver Ed Smith of Portland were cited and released. All three pleaded innocent to the charges, punishable by a fine of up to $1,000 and three months in jail.
Smith appeared with Stoudamire in the seven-minute hearing and agreed to the same terms.
"I appreciate everything, all the support, and we'll stay out of trouble," Stoudamire said as he left the courthouse.
Wallace did not attend the hearing because he had not yet completed a drug evaluation survey. He was expected reach the same agreement when he appears in court March 31.
If Smith or either player violates the agreement, the case will return to Judge Michael Rowe.
Prosecutors agreed to the terms because of problems with how the evidence was gathered, secured and tested, prosecutor Jeremy Randolph said.
Last February, Stoudamire and his father were charged with felony possession of marijuana after a police search of Stoudamire's home turned up the drug.
The charges against Stoudamire's father were dropped and a judge declared the search illegal and rejected a prosecution request to use the marijuana as evidence. That ruling has been appealed. |
